Definisi Hukum Militer Menurut Para Ahli. Mr. S.J. Fockermar Andreae dalam bukunya “Rechtsgeleerd Handwoordenboek” (cetakan ke-2) halaman 185 menyatakan: Militair recht: het bijzondere straf en tuchtrecht vbor de militairen geldence.

Encyclopaedia Brittanica (1951) Vol. XV halaman 481 mengatakan: English Millitary Law embraces both a pertal code for the maintenance of dicipline of the army and also administrative laws which provides for the maintenance of the army.

Oxfort Junion Encyclopaedia (1957) Vol. X halaman 116 menguraikan: Military Law is the code rules, laid down in the Army act, which regulated the army and the air force.

Chamber’s Encyclopaedia, New Edition (1959) Vol. IX halaman 405 menambah lagi dengan: Military Law mean all the law that deals with national armed forces, including laws and usages governing methods of conducting warfare of administering occupied enemy territory and of maintaining discipline among prisoners of war. It is sometimes used to include also those laws that authorize military interference with the normal rights of civilians such as law enabling compulsory billeting of soldiers.

Richard C. Dahl. BLS, LLB dan John F. Whelen SA dalam bukunya “The Military Law Dictionary” (Ocean Publications, Inc. New York, 1960 halaman 102 menyatakan: Military Law:

• Those laws relating to the government of the Armed Force;
• That body or system of rule for the conduct of military personel;
• In a limited sense, the uniform Code of Military Justice.

Encyclopaedia Brittanica tersebut di atas pada halaman yang sama memberikan uraian: French Military Law Comprises the Law on:

• The organization of the nation in time of ware;
• The general organization of the Army;
• The constitution of cadres and effectives on recruiting for the Army;
• The principles of reduction of compulsory services to on a year;
• The respect of international agreements;
• The protection of frontiers etc.

Der Grote Brookaus, Jilid XII halaman 551 mengatakan bahwa: Militarrecht, die Gesamheit der sich auf das Militar beziehenden Rechtsatze.

Untuk istilah Militarrecht sekarang dipergunakan juga istilah Wehrrecht, yang merupakan Himpunan Hukum Militer Jerman, dibuat oleh Brandstetter (Handbuch des Werrecht, tiga jilid) meliputi antara lain:

• Wehrverfassung (Undang-Undang Pertahanan);
• Rechtstellung, Plichten und Rechts (kedudukan Hukum, Kewajiban-kewajiban dan hak-hak);
• Disiplinerstrafrecht (Hukum Pidana Disiplin);
• Strafrecht (Hukum Pidana);
• Leistungsrecht (Hukum Lalu Lintas);
• Burgerliches Recht (Hukum Perdata);
• Kriegsvolkerrecht (Hukum Perang).

Dari definisi-definisi hukum militer menurut para ahli di atas nyatalah bahwa ruang lingkup hukum militer di negara-negara tersebut adalah berbeda-beda. Kalau di Belanda umpamanya hanya meliputi hukum pidana dan hukum disiplin militer saja, maka negara-negara seperti Jerman, hukum militer lebih luas cakupannya. Kemudian jika di Inggris masi ada pendapat bahwa hukum militer hanya berlaku untuk “the army” saja (atau juga kemudian untuk “the air force”), maka di Belanda jangkauannya meliputi seluruh Angkatan Bersenjatanya.
